The Notice of Intended Prosecution was sent three weeks after the date of the offence. Is this too late?

The law requires that a Notice of Intended Prosecution must be sent to the person who is the registered keeper of the vehicle within 14 days of the alleged offence. The requirement for it to be sent within 14 days only relates to the first Notice of Intended Prosecution that was sent for the offence. If the keeper nominates someone else as the driver, that person would then be sent a further Notice of Intended Prosecution. There is no requirement for subsequent notices to be sent within 14 days of the offence date.
